Please read these terms carefully before placing an order.
These Terms and Conditions apply to all sales of goods through the Easy Build Stone website and by any other means. Easy Build Stone is a trading name of Black Mountain Quarries Ltd (“the Company”). Where the Customer is acting in the course of business, the additional provisions in Section 16 also apply.
1.1 “Customer” means the person or business purchasing Goods from the Company.
1.2 “Goods” means all natural stone cladding slips, corner pieces, adhesives, pointing mortars and ancillary materials supplied under the Easy Build Stone brand.
1.3 “Agreement” means the accepted order between the Company and the Customer for the supply of Goods.
2.1 Orders placed online, by email, by phone or by purchase order constitute an offer to purchase.
2.2 An Agreement is formed when the Company confirms acceptance in writing or dispatches the Goods.
2.3 Any terms contained within a Customer purchase order that conflict with these Terms shall not apply unless expressly agreed in writing by the Company.
2.4 Quotations are valid for 30 days unless otherwise stated.
3.1 All prices are shown in GBP (£).
3.2 Prices are shown both exclusive and inclusive of VAT on product pages. VAT is charged at the prevailing rate.
3.3 Delivery charges are additional and are calculated at checkout based on your location and order size.
3.4 The Company reserves the right, where reasonably necessary, to adjust prices prior to dispatch to reflect significant increases in raw material, labour, transport or regulatory costs beyond its reasonable control.
4.1 Full payment is required before Goods are dispatched. Payment is processed securely through Stripe.
4.2 Where a credit account has been agreed in writing, invoices are payable in accordance with agreed terms.
4.3 The Company reserves the right to suspend deliveries where payment is overdue.
5.1 Delivery is kerbside only unless otherwise agreed in writing. Please read our Delivery Information page in full before ordering.
5.2 Stone is delivered by 18-tonne lorry fitted with a tail lift and manual pump truck. There is no crane or hiab on board.
5.3 The Customer is responsible for ensuring suitable access for the delivery vehicle and for making arrangements to move Goods from kerbside to their final location.
5.4 Delivery dates are estimates only and do not form part of the Agreement.
5.5 Where offloading time is unreasonably extended due to circumstances within the Customer's control, the Company reserves the right to charge reasonable additional waiting costs.
5.6 The driver may refuse to position or offload where ground conditions, access, gradient, overhead obstructions or safety concerns make delivery unsafe. Re-delivery charges will apply.
5.7 The Company accepts no liability for damage to driveways, paving, underground services or property unless caused by negligence.
5.8 The Company is not responsible for the removal or disposal of pallets or packaging.
6.1 The Customer must inspect Goods upon delivery and note any visible damage or shortage on the driver's paperwork at the time of delivery.
6.2 Any damage or shortages must be reported to the Company in writing within 48 hours of delivery. Claims made after this point cannot be accepted.
6.3 Goods that have been cut, installed or altered are deemed accepted and cannot be returned.
7.1 The Goods are natural stone products. Variations in colour, shade, texture, fossilisation, veining, markings and size are inherent characteristics of natural stone and shall not constitute defects.
7.2 Samples are provided as a general indication of colour and character only. A single sample piece cannot represent the full range of tonal variation within a larger consignment.
7.3 Where an accurate representation of the overall appearance is important, Customers are advised to order a sample area of approximately 1m² before committing to a full order.
7.4 Natural stone may weather and change in appearance over time. This is a normal characteristic of the material.
8.1 Stone cladding slips must be installed by a competent person in accordance with current industry best practice.
8.2 The installer is responsible for ensuring the substrate is structurally sound, clean, dry and suitable for stone cladding.
8.3 Appropriate adhesives and pointing mortars suitable for the intended environment must be used.
8.4 All joints must be fully pointed to prevent water ingress. Inadequate pointing is a common cause of failure and is the installer's responsibility.
8.5 Where slips are to be installed at a height exceeding 3.0m from ground level, mechanical fixing may be required. The installer must consult current building regulations and local codes of practice prior to installation.
8.6 The Company accepts no liability for failure arising from incorrect installation, inadequate substrate preparation, insufficient pointing, inappropriate fixing methods or poor workmanship.
9.1 The Customer is responsible for ordering sufficient quantities of Goods, including an appropriate allowance for cutting, waste and breakage. We recommend adding 5–10% to your measured area.
9.2 The Company cannot guarantee that subsequent orders will be an exact match to previous deliveries, as natural stone varies between consignments.
10.1 Where bespoke, sawn or made-to-order products are agreed, they are manufactured to agreed nominal dimensions. Minor dimensional tolerances are inherent within natural stone processing and do not constitute defects.
10.2 Orders for bespoke or made-to-order products cannot be cancelled once manufacturing has commenced.
11.1 Risk in the Goods passes to the Customer upon delivery.
11.2 Legal title to the Goods shall not pass until payment has been received in full in cleared funds.
11.3 The Company reserves the right to recover Goods that remain unpaid.
The Company shall not be liable for any delay or failure to perform arising from circumstances beyond its reasonable control, including but not limited to supplier failure, transport disruption, extreme weather, labour shortages or government restrictions.
The Customer is responsible for ensuring appropriate health and safety measures are followed in relation to the handling, storage and installation of the Goods, including compliance with all applicable regulations.
14.1 If the Customer is a consumer purchasing at a distance (online or by phone), they have the right to cancel within 14 calendar days from the day after delivery, provided the Goods are returned in their original, undamaged condition at the Customer's cost.
14.2 The right to cancel does not apply to Goods that have been cut, installed, altered or mixed.
14.3 Nothing in these Terms affects the Customer's statutory rights under the Consumer Rights Act 2015.
Personal data collected in connection with orders is processed in accordance with UK GDPR and our Privacy Policy.
16.1 Business Customers must notify the Company of any defects or shortages in writing within 7 days of delivery.
16.2 The Company's total liability to a business Customer shall not exceed the price paid for the Goods in question.
16.3 The Company shall not be liable to business Customers for indirect or consequential losses, loss of profit, project delay costs or wasted labour.
16.4 Statutory interest may be charged on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
